Terms & conditions

These terms apply to all contracts for goods, storage and works undertaken by us on or after August 2025

Use of our goods and services is acceptance of our terms and conditions.

  1. Liability
    1a. Clark’s Boatworks LTD accepts no liability for loss or damage caused by events or circumstances outside of our reasonable control. This includes the weather conditions or actions from third parties not employed by us. Extending to loss or damage of vessels and equipment or any other property left with us for work or storage purposes. Including any harm to people entering the premises or using our facilities or equipment. Subject to this all vessels, and work undertaken, are stored, worked on, moved or otherwise managed at the sole risk of the owner.
    1b. Customers should ensure that their vessels and/or property, and themselves, are insured against all third-party risks, as they may be liable for damage caused by their vessels, themselves or their crew, whilst on the premises. This insurance should be shown to Clark’s Boatworks LTD, if requested, within a week from request.
    1c. Clark’s Boatworks LTD reserves the right to seek indemnity against any damages or costs brought against the company, in the event where Clark’s Boatworks LTD is not liable, due to third party negligence.

  2. Vessel movement.
    2a. Clark’s Boatworks LTD reserves the right to move vessels, gear and vehicles, in the interest of safety, security and good management of the premises, at our discretion.
    2b. Any vessel movements by yourselves must be pre-approved by Clark’s Boatworks LTD.

  3. Charges/Prices and Estimates
    3a. Prices are based on the cost of labour and materials. A quote should be accepted within a reasonable time frame, to avoid any changes in the above, affecting the cost of work undertaken.
    3b. Clark’s Boatworks LTD will endeavour to inform customers of any rise in costs, due to unforeseen circumstances.
    3c. Clark’s Boatworks LTD reserves the right to make changes to storage prices, with prior written notice to the customer.

  4. Payment
    4a. Payments are due within 7 days of invoice receipt. Unless otherwise agreed between Clark’s Boatworks LTD and the customer.
    4b. After 30 days of non-payment for work, storage charges will be incurred at our usual rates.
    4c. After 30 days of non-payment of any type of invoice, interest will be charged at the rate of 5% of the outstanding balance.
    4d. If you are due to sell your vessel, before the change of ownership commences, all debts must be paid in full.
    4e. You are not permitted to remove your vessel from the premises unless Clark’s Boatworks LTD has received your payment in full.
    4f. Any costs incurred by us having to chase payment of debt will be passed onto the vessel owner.


  5. Delays
    5a. All delivery/completion of work dates are given in good faith and are not guaranteed. Clark’s Boatworks LTD shall always endeavour to complete works and deliveries as close to any quoted date, subject to the circumstances of each particular contract, whilst keeping customers up to date on any changes.

  6. Retention of title
    6a. Unless any other agreements have been made, Clark’s Boatworks LTD reserves the right to exercise a general lien upon vessels and or equipment on site, until payments due have been received and cleared in full. Under these circumstances, Clark’s Boatworks LTD reserves the right to deny any customer owing monies, access to the premises.

  7. Subcontracting
    7a. Subcontractors should report to office or management upon arrival at the premises. 7b. Subcontractors should not interfere with the day to day running of Clark’s Boatworks LTD
    7c. It is necessary for all contractors and subcontractors to be in possession of public liability insurance, with a minimum coverage of £3,000,000, this insurance should be presented to Clark’s Boatworks LTD upon request.
    7d. Clark’s Boatworks LTD reserves the right to refuse access to any subcontractors.
    7e. In the event that Clark’s Boatworks LTD must oversee subcontracting work being undertaken this will charged at our usual hourly rate.

  8. Parking
    8a. Parking is not guaranteed due to lack of space. It will not be possible to park next to your vessel. Parking is solely reserved for people working on vessels and staff. If there is space, please request permission to park from the office. This is due to the moving of Plant Machinery around the premises. 8b. Parking vehicles on the premises is expressly at the owner’s sole risk. Clark’s Boatworks LTD accepts no liability for vehicles and property on the premises. Including damage to persons and property caused by these vehicles.

  9. Access to Premises and vessel
    9a. All persons using any part of the Clark’s Boatworks LTD premises do so at their own risk. Whether this is by invitation or otherwise.
    9b. For safety reasons you are not permitted to adjust or remove any supports, supporting your vessel, for any reason. This includes, but is not limited to, repairing and maintaining your vessel. In the circumstance where access to supported areas is needed, please contact Clark’s Boatworks LTD for assistance.
    9c. Prior consent must be sought for work and services to be carried out on a vessel, equipment, or gear, whilst on site, whether this be by an owner or subcontractor. Excepting of minor maintenance or running repairs of a routine nature. This is permitted so long as it does not interfere with the day to day running of the premises and not causing any nuisance to neighbours or others using the premises. Reasonable access is only permitted when safe to do so, and when a vessel is not being worked on by us or our subcontractors.

  10. Salvage
    10a. Clark’s Boatworks LTD are not under any obligation to salvage a vessel, or property, when the consequences are due to a defection on the vessel, or property, unless we have been requested to do so, on a contractual basis. This also applies under circumstances where an accident occurs, and Clark’s Boatworks LTD is not at fault.
    10b, Clark’s Boatworks LTD does however reserve the right to salvage a vessel when it is interfering with the day to day running of the premises or poses a safety risk. This will be charged to the customer.

  11. Overnight stays
    11a. No overnight stays on a vessel, unless prior consent from Clark’s Boatworks LTD has been sought.
    11b. A maximum occupancy of 2 people per vessel staying overnight, any extra people must be by prior arrangement. This includes any pets.
    11c. Noise levels are to be kept to a minimum overnight.
    11d. Overnight stays will be charged by your vessel’s electricity usage. This will be charged per kwh. If anyone is caught tampering with the meters this will incur a fine.

  12. Facilities
    12a. No dis-charging, from your vessel, whilst on Clark’s Boatworks LTD premises.
    12b. A toilet and shower are available for use by anyone on site. Please leave these as you would wish to find them.
    12c. If you have an issue with the provided facilities, please contact a member of Clark’s Boatworks LTD.

  13. Notices/termination
    13a. Clark’s Boatworks LTD may from time to time, as where appropriate for the good management of business, need to terminate a contract with a customer, even when they are paid in full. Clark’s Boatworks LTD will give this notice in writing, 4 weeks in advance.

  14. Right of Sale
    14a. Acceptance of a vessel or equipment by Clark’s Boatworks LTD, for repair storage or any other purpose, is subject to the provisions of the Torts (interference with goods) Act 1977. Allowing Clark’s Boatworks LTD a right of sale exercisable over a vessel or other property under certain circumstances. A sale would not take place until notice to the customer has been granted. If outstanding balance has not been paid within 3 months of being served notice the vessel will be sold.

  15. Social Media
    15a. Use of images, videos and audio, taken on our premises, and of our staff working elsewhere, is retained solely for the use of Clark’s Boatworks LTD. If you would like to share images, video or audio taken on the premises, or of our staff working, please make a request to the office.

  16. Waste management
    16a. You must make sure that the area around your vessel is kept clean and tidy. There are skips and bins available to use onsite for small things. This waste must be separated into suitable bins. We provide a metal bin, recycling bin and general waste bin. 16b. Any large amounts of waste must be taken home with you, or you may arrange for waste removal at your own cost. 16c. Clark’s Boatworks reserves the right to pass on any charges for excessive use of our waste bins.

Any contracts made on behalf of Clark’s Boatworks LTD are governed by English Law.

We reserve the right to vary the terms of business at any time in order to abide by any legal or regulatory changes as may be appropriate.
